Recovery of Insurance Proceeds and Assets Following Wrongful Death
An experienced personal injury attorney brought Reynolds Gillette into a wrongful death matter after the dispute expanded to include Colorado's Slayer Statute, disputed life insurance proceeds, nominee ownership issues, and asset recovery concerns. The representation required international service of process, litigation concerning ownership and beneficiary rights, and an evidentiary hearing resulting in a $9 million judgment. The representation subsequently included recovery of approximately $6 million in life insurance proceeds, plus accrued interest, together with recovery of real properties and investment accounts located in multiple states.
Defense of Arbitration Claims Arising from Sale of Investment Business
Represented a business owner in a FINRA arbitration arising from the sale of a financial services business. The opposing parties alleged fraud, collusion, and related misconduct and sought a seven-figure damages award. Following a three-week arbitration hearing, the panel rejected all claims and entered a complete defense award.
Recovery of Commission and Defense of Fraud Claims Following Sale of Ranch Property
Represented a real estate brokerage firm seeking recovery of a commission arising from the sale of ranch property. The dispute evolved into litigation involving fraud allegations, trial, and collection proceedings. Obtained judgment in favor of the client, recovered attorney fees and interest, and successfully defended the result.
Recovery of Earnest Money Following Failed Aspen Real Estate Transaction
Represented the owner of Aspen real estate following a failed $17.5 million transaction. After the purchaser breached the agreement, the client sought recovery of $875,000 in earnest money. The dispute became substantially more complicated when a third party intervened and asserted competing claims to the same funds. Following more than four years of litigation, recovered the earnest money, prejudgment interest, attorney fees, and costs, resulting in a judgment exceeding $1.4 million.

Represented a client whose attorney's negligence resulted in the loss of a substantial personal injury claim. The representation required proving the underlying claim, the attorney's negligence, and collectability issues that would have affected recovery. Represented an attorney and law firm facing claims exceeding $20 million arising from trust, estate planning, and asset protection advice. Successfully narrowed the claims through motion practice and discovery and achieved a favorable resolution substantially below the damages sought.

Represented a certified public accountant accused of professional negligence in a multi-million-dollar dispute involving complex financial and accounting issues. Resolved the matter without any payment by the client.

Represented beneficiaries and trust interests in a dispute involving administration of an estate and the conduct of the court-appointed personal representative. The matter involved contested probate proceedings, enforcement of settlement obligations, and recovery efforts involving estate assets located in multiple states. Achieved a negotiated resolution requiring payment of amounts owed to the beneficiaries, together with accrued interest and attorney fees, and secured recovery from estate assets located in Georgia and California.

Represented a former Colorado sheriff in litigation involving defamation claims and issues of public concern. The matter presented significant professional and reputational consequences. Obtained dismissal of the claims and successfully defended the result.

Represented an attorney sued as a result of efforts to enforce a judgment on behalf of a client. Obtained dismissal under Colorado's Anti-SLAPP statute, recovered attorney fees and costs, and successfully defended the judgment.

Represented judgment creditors seeking to recover money and assets after obtaining judgments in commercial disputes and other litigation. These matters involved domestication of foreign judgments, debtor examinations, garnishments, charging orders, and enforcement proceedings in multiple jurisdictions. Recovered money and assets that would otherwise have remained beyond the reach of creditors.
Recovery of Assets Hidden Through Transfers and Ownership Structures
Represented judgment creditors pursuing claims involving transfers to family members, insiders, affiliated entities, and third parties. These matters required investigation of ownership structures, financial transactions, and efforts designed to place assets beyond the reach of lawful collection efforts. Successfully pursued claims to recover assets and unwind transactions that interfered with enforcement of valid judgments.
