Recovery of Insurance Proceeds and Assets Following Wrongful Death
Obtained a $9 million judgment following an evidentiary hearing involving Colorado's Slayer Statute, disputed ownership interests, and beneficiary issues. The representation subsequently included recovery of approximately $6 million in life insurance proceeds, plus accrued interest, together with recovery of real properties and investment accounts located in multiple states.
Defense of Arbitration Claims Arising from Sale of Investment Business
Obtained a complete defense award following a three-week FINRA arbitration arising from the sale of a financial services business. The opposing parties alleged fraud, collusion, and related misconduct and sought a seven-figure damages award. The award was later confirmed as a judgment.
Recovery of Commission and Defense of Fraud Claims Following Sale of Ranch Property
Obtained judgment for a real estate brokerage firm seeking recovery of a commission arising from the sale of ranch property. Recovered attorney fees and interest and successfully defended the result.
Recovery of Earnest Money Following Failed Aspen Real Estate Transaction
Represented the owner of Aspen real estate following a failed $17.5 million transaction. After the purchaser breached the agreement, the client sought recovery of $875,000 in earnest money. Following more than four years of litigation, recovered the earnest money, prejudgment interest, attorney fees, and costs, resulting in a judgment exceeding $1.4 million.
Defense of Public Official Against Defamation Claims
Successfully defended a former Colorado sheriff against defamation claims that threatened his professional reputation and personal finances. Obtained dismissal of the claims and successfully defended the result.
Legal Malpractice Recovery
Represented a client whose attorney's negligence resulted in the loss of a substantial personal injury claim. Obtained a confidential recovery exceeding the insurance coverage available in the underlying matter.
